⚖️ ABOUT THIS VIDEO
If the mother is earning well, is the father still solely responsible for the child’s maintenance? Or should both parents automatically bear the expenses in a 50:50 ratio?
Indian maintenance law does not prescribe any fixed 50:50 formula.
In this video, Advocate Naresh Kudal explains the legal responsibility of an earning mother and father towards their child under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 125 CrPC), along with important judgments of the Supreme Court, Delhi High Court and a recent 2026 decision of the Karnataka High Court.
The video explains why both parents may have a responsibility to maintain their child, but their financial contribution need not always be equal. Courts may consider the respective income and financial capacity of both parents, the reasonable needs of the child, educational and medical expenses, and the day-to-day care provided by the parent having custody.
