Many doctors feel relieved and think, “The hospital’s legal team will handle it.” Pause and ask: whose lawyer are they? The hospital’s legal team has one client, the hospital. Its duty is to protect the institution’s systems, staff, policies, reputation and finances. You may need to defend your individual clinical decisions, your documentation and your professional conduct. These interests often overlap. But when the question becomes whether it was the doctor’s clinical error or the hospital’s system failure, they can move apart quickly. And if your consultant agreement has an indemnity clause, who finally pays may itself become a dispute between you and the hospital. Before a crisis occurs: 1. Understand your consultant agreement, especially the indemnity and liability clauses. 2. Maintain adequate personal Professional Indemnity Insurance. 3. Know exactly what the hospital’s insurance covers, and whether it covers you. 4. Have access to independent medico-legal and legal advice that answers only to you. 5. Consider professional medico-legal risk-management support for documentation, consent and agreement review. Institutional legal protection and personal legal protection are not the same thing.
