The Uniform Civil Code (UCC) has been a constitutional promise since the adoption of Article 44, but its journey in India remains deeply contested. While Uttarakhand and Goa currently have UCC laws in place, Assam, Gujarat and Madhya Pradesh have passed legislation that is yet to come into effect. The debate becomes more complex when these state laws are compared, as they differ significantly on issues such as live-in relationships, marriage registration, divorce, adoption, inheritance, polygamy and tribal exemptions. The newer UCC laws require registration of live-in relationships and impose penalties for certain violations, while Goa follows a distinct legal framework rooted partly in Portuguese civil law. The script also traces the historical debate around UCC in the Constituent Assembly, the views of B R Ambedkar and K M Munshi, and the Law Commission's positions in 2018 and 2023.
