What You Should do if Your Hearing Takes an Unexpected Turn

Most of the time, your #socialsecuritydisabilityhearing will follow an expected course. Your #disabilitylawyer will explain how your judge handles cases and you will practice with your lawyer answering the questions you are likely to face. But what happens if things go off script? Perhaps the judge assigned to your case can’t appear and a different judge is presiding. Maybe you have a new judge who has his or her own way of holding hearings. Maybe your judge is just off-the-wall and asks questions that you were not expecting at all. Similarly, what should you do if you sense that your lawyer is inexperienced or not prepared, and you sense that the judge is getting angry or frustrated. You have likely waited two years or longer for this 45 minute hearing and you can’t risk having your hearing end without putting all of the evidence and testimony about your disability on the record. As I discuss in this video, the odds of unpleasant surprises at your hearing are low but you should prepare yourself mentally for all possibilities. Most importantly you must keep in mind the main issue for any disability claim - does the evidence in your file show that your medical or mental health condition prevents you from reliably performing a simple, entry-level job.
