The AMD Am386 ran at 40 MHz when Intel's 386 stopped at 33, yet it had to beat Intel in court before it was safe to sell. By the time the last appeal ended, PC makers had already moved on to the 486.
AMD signed a ten-year second-source deal with Intel in February 1982. Intel quietly stopped accepting AMD designs, AMD demanded arbitration in 1987, and hearings ran 355 days. AMD shipped its own 386 in March 1991 and took roughly 40% of that market within a year. The arbitrator awarded only $15 million, partly blaming AMD's own delay. The California Supreme Court upheld his award on December 30, 1994.
