Days before the sale, unreleased Oasis recordings, estimated by the auction house at more than a million pounds, were pulled from auction. Reports say the band had taken legal action. Who owns a night that someone else recorded?
The tapes come from Oasis shows in the nineties. The band's former live sound engineer kept them for decades, by his family's account, and his son brought the archive to sale. Littleton Auctions offered it as the Desk Tapes: digital tapes, cassettes and MiniDiscs, said to hold sixty-three live shows, plus rehearsals and soundchecks. In the auction house's description, the shows were recorded directly from the sound desk. Why they were taped, who arranged it and what the band agreed to at the time have not been made public.
What has been reported: at the end of September, reports say legal action was taken in London's High Court by the band's partnership, by Liam and Noel Gallagher, and by their record labels. Named on the other side were the auction house, the engineer and his son. The lot was then withdrawn “pending the outcome of legal proceedings.” His son said: “We have agreed to postpone the auction.” The sale was set for 3 October 2026, and the auction house said the rest of it was unaffected. No ruling on who owns what has been reported, and a withdrawal is not a verdict. Apart from the auction house's early report that the band had “expressed concerns,” we found no public statement from the band on the case. That silence proves nothing either way. At the time of writing, the lot was still withdrawn.
The film explains the general law separately. In Britain, one box of tapes can hold several different things, each with its own owner. The tapes themselves are objects. A sound recording has its own copyright, which first belongs to whoever made the arrangements for it to be made. Performers have rights of their own, separate from copyright, and recording, copying or putting out a performance generally needs their consent. A British court has said that consent can be express or implied. The music and the words carry copyrights of their own. Copyright is transferred only in writing, signed by the owner. So as a general rule, buying the tapes buys the tapes, and copying or releasing what is on them takes other permissions, from other people. That is the general law of the UK, not a ruling on this case. The band's actual claim has not been made public.
A sale, a settlement, a licence or a ruling could each open the box. Until then, it stays shut. But the night was never only in the box.
