Green Card Holders With Old Convictions Are Being Detained at CBP, What We Were Told at LAX

We just finished a two hour meeting with CBP LAX Deferred Inspection management, along with a team of immigration attorneys, and the news for lawful permanent residents is worse than expected. If a returning green card holder has a conviction that could be read as a crime involving moral turpitude, we were told officers have no discretion. The case goes to counsel and to ICE, and detention at the airport is likely, sometimes for days, before an NTA is ever issued and before bond is even possible. Convictions from before the green card was granted still count. Green card holders also cannot voluntarily withdraw their application for admission, while a visa holder with the same offense and a valid visa is admitted. That is the part that shocked the room. Important: this reflects what one port of entry shared with attorneys at this meeting. It is not a published nationwide policy change, and the underlying immigration law has not changed.
