INSTRUCTION NO. 02/2022-23 (GST INVESTIGATION] As per para5.1.1.1 In cases, where a person is arrested u/s 69 of CGST Act, for an offence which is bailable, the Assistant Commissioner/Deputy commissioner is bound to release a person on bail against a bail bond. Under GST as per section132(4) CGST Act, offences upto Rs. 5crore are bailable. Thus for offences upto 5crore, granting of Bail is compulsory.
