The jury asked to see it again: the earbuds, the photographs, the lab results, the internet searches. Here is every minute of what they got, and what they did not.
Day 9 of State of North Carolina v. David Prevatte is the jury's second day of deliberations. David Prevatte is the uncle on trial in the death of his five-year-old niece, Paitin Fields, in Pender County, North Carolina, in November 2017. He says he found her and tried to save her. The State named him a suspect in 2018 and charged him more than four years later. He is presumed innocent, and no verdict came on Day 9.
The judge reads the jury's note aloud. The jurors want the red earbuds, which their note says the defense attorney touched and are now "contaminated," along with the photographs, every DNA lab result and the internet searches, so they can talk them over in private. The judge, Ms. Smircic and Mr. Britt spend the rest of the morning working out what can be shown and how.
After lunch the defense objects to any evidence going back to the jury room, and the judge keeps all of it in the courtroom. Jurors put on gloves and pass the earbuds, then the lab summaries, from hand to hand in silence. This Edition keeps that silence whole: it is live court, and it is the jury at work. The photographs come next; the court excluded them from the broadcast, so the camera stays on the defense table.
One ruling deserves a second look. The jurors asked for the internet search records by exhibit number, and the judge ruled them too voluminous to show, telling the jury to rely on its memory of Investigator Eric Short's testimony. When a jury asks to see evidence that was admitted, is memory a fair substitute?

0:07:39 The jury's note: they ask to see the earbuds, the photographs, the lab results and the internet searches. The judge reads it word for word, then the lawyers and the judge sort out what the jury can see. After lunch the defense objects to sending any of it back to the jury room.
0:44:13 After lunch, the judge tells the jury how it will view the evidence. Gloves on, in the courtroom, and without comment.
0:48:19 The jury views the earbuds and then the lab summaries, passed juror to juror. Live court in silence, kept whole.
3:26:13 The jury sees the photographs, not the search records. Watch what the jurors are told to rely on instead.
3:37:40 No verdict on Day 9: the jury is sent home until tomorrow morning. The judge takes back the verdict forms and the jury instructions and recesses court until 9:30 the next morning.
