Accused Uncle Seeks Mistrial Over BOMBSHELL KKK Comments

The judge removed a juror from David Prevatte’s murder trial after finding she was not “honest and forthright” about allegedly sharing information about the defendant that was not presented in court. Juror No. 3 reportedly told fellow jurors that Prevatte was not a member of the Ku Klux Klan (KKK), had been ostracized in his community and could not be racist because his girlfriend is Black and they share a child. Prevatte’s defense attorney argued the comments may have “poisoned” the entire jury panel and said the defendant could no longer receive a fair and impartial trial, effectively seeking a mistrial. The judge found the remaining jurors said they could remain fair and impartial, but had not yet ruled on whether the trial could continue with an alternate juror replacing Juror No. 3.
