If you have a family court hearing coming up, you probably have questions: What exactly is a family court hearing? What happens during the hearing? How should you prepare? Attorney Tatiana Gerimky, with 22 years of family law experience, answers all your questions about the family court hearing process in Washington State.
In this video, you'll learn:
What is a Family Court Hearing?
A family court hearing is where a judge or court commissioner hears and decides on motions related to your divorce or family law case. In Washington State, 99% of hearings now take place via Zoom.
Understanding Motions
Before any hearing can happen, someone must file a motion—a written document asking the court to take action. Common motions include requests for attorney's fees, temporary parenting plans, child support, and other temporary relief during your divorce process.
How to Prepare for Your Hearing
Reserve Your Date: In King County, you must reserve your hearing date in advance on the court's website
Gather Required Documents: For financial relief requests, you'll need six months of bank statements, two years of tax returns, and a completed financial declaration
Follow Local Court Rules: Failure to submit proper documentation will result in your hearing being continued to a later date
What Happens During the Hearing
Multiple cases will be scheduled, and you'll need to wait patiently until your case is called
Arguments are limited to what was submitted in writing beforehand
The person who filed the motion argues first (5 minutes in King County)
The other side responds
Brief rebuttal is allowed
The court commissioner typically makes a decision immediately, though complex cases may receive a written decision within a few days
Important Courtroom Etiquette
Even though hearings are conducted via Zoom, you must maintain proper courtroom decorum:
Dress in business casual attire
Don't interrupt the other party
Never argue with the judge
Avoid eating or drinking during the hearing
Act professionally at all times
Whether you're representing yourself or have an attorney, understanding the family court hearing process will help you feel more confident and prepared.
