INDIA’S NEW IT RULES: IS CRITICISING THE GOVERNMENT ABOUT TO BECOME A LIABILITY?
India is preparing to change the rules governing social media platforms.
The proposed changes could make companies more legally vulnerable over user-generated content and bring individual users publishing news and current affairs under tighter regulation.
The question is bigger than Big Tech.
What happens to ordinary citizens, journalists and independent media when platforms become afraid to host criticism of the government?
——
[00:00] VIDEO HIGHLIGHTS
🔹 The legal protection facing a major test
🔹 New rules, wider government oversight
🔹 Why platforms could silence critical voices
🔹 The chilling effect on independent journalism
——
[02:48] CHAPTER 1: THE LEGAL SHIELD UNDER THREAT
Section 79 of the IT Act gives social media intermediaries conditional legal protection for content posted by users. This is the principle of Safe Harbour. It allows millions of people to publish without platforms becoming automatically liable for every post. But the proposed changes could alter that balance. The consequences extend far beyond technology companies.
“सवाल पूछने के अधिकार का है।” [02:39]
——
[04:18] CHAPTER 2: THE GOVERNMENT’S PROPOSED RULEBOOK
The proposed changes raise questions about mandatory compliance with government directions, platform liability and the regulation of news and current affairs content posted by individual users. Government review powers and data preservation requirements add another layer. Independent journalists and smaller digital publishers could find themselves operating under a significantly different regulatory environment.
“अब नए प्रस्ताव में सोशल मीडिया पर न्यूज़ और करंट अफेयर्स पोस्ट करने वाले यूज़र्स को भी इसके दायरे में लाने की बात है।” [05:10]
——
[09:13] CHAPTER 3: WHEN FEAR BECOMES CENSORSHIP
A platform facing legal consequences has an incentive to minimise risk. Removing controversial content or restricting its reach could become easier than challenging government directions. This is where the chilling effect begins. Journalists hesitate. Citizens think twice. Political criticism becomes a potential liability even before any formal censorship takes place.
“सबसे खतरनाक स्थिति वो है जिसमें लोग खुद ही बोलना बंद कर देते हैं।” [09:40]
——
[10:52] CHAPTER 4: THE OTHER SIDE OF PLATFORM ACCOUNTABILITY
There is a legitimate case for holding technology companies accountable. Fake news, hate speech, online fraud and child sexual exploitation demand serious intervention. The NHRC has also directed an investigation into allegations involving child sexual exploitation content promoted through paid Instagram advertisements. But tackling criminal content and restricting political dissent are two entirely different responsibilities.
“लेकिन यहां भी एक अंतर समझना होगा। बच्चों के यौन शोषण, हिंसा और अपराध से जुड़े कंटेंट पर कार्रवाई करना एक बात है और सरकार की आलोचना, राजनीतिक जंग और असहमति को नियंत्रित करना दूसरी बात है।” [11:40]
——
[13:26] CHAPTER 5: THE QUESTION THE GOVERNMENT MUST ANSWER
The proposed changes have already attracted criticism from digital rights advocates. The central concern is transparency. Who decides what gets removed? Can platforms and citizens challenge government directions? Will independent scrutiny exist? And can the government guarantee that criticism of the Prime Minister, ministers or public policy will not be suppressed simply because it makes those in power uncomfortable?
“लोकतंत्र में सरकार जनता के प्रति जवाबदेह होती है। जनता सरकार के प्रति नहीं है।” [14:16]
