Is the Caribbean Court of Justice facing its most serious crisis of confidence? Senior Attorney Nigel Hughes examines the CCJ controversy, judicial independence, panel selection, accountability and what it could mean for the CSME, investors and Caribbean rule of law. In Season 4, Episode 7 of Caribbean Business Review, host Joseph Cox speaks with Nigel Hughes, Managing Partner of Hughes, Fields and Stoby in Guyana, following leaked internal correspondence in which five sitting CCJ judges reportedly raised concerns involving panel composition, judicial influence and the exercise of authority at the Court’s highest level. The central question goes beyond the leaked emails: what happens when litigants begin questioning not simply a judgment, but the process that produced it? Hughes examines the institutional mechanisms available for addressing allegations involving the leadership of the Court, the limits of the existing accountability framework, and why confidence in judicial process matters far beyond judges and lawyers. For Caribbean businesses, governments and investors, the stakes are significant. The Caribbean Court of Justice’s Original Jurisdiction is central to interpreting and applying the Revised Treaty of Chaguaramas and the functioning of the CARICOM Single Market and Economy (CSME). Questions surrounding judicial confidence can therefore extend into commercial dispute resolution, regional integration, investment risk and confidence in Caribbean institutions.
