‘Sitting SC judge should not comment on pending matter’: Former CJI Gavai on Justice Bhuyan’s SIR remarks

Former Chief Justice of India B.R. Gavai has strongly reacted to Supreme Court Justice Ujjal Bhuyan’s public remarks on the Special Intensive Revision (SIR) of electoral rolls. Speaking at an event at NALSAR University of Law in Hyderabad, Justice Bhuyan said any process that disenfranchises millions of Indian citizens, making them citizens without voting rights, is “intrinsically arbitrary” and strikes at the heart of the Constitution. He also referred to Articles 14 and 326 while criticising large-scale deletion of voters. Former CJI Gavai responded by stressing judicial propriety. He said a sitting Supreme Court judge should not make public comments on a matter that is still pending adjudication before the same court. Retired Delhi High Court judges have also questioned the remarks, calling them beyond the limits expected of a sitting apex court judge.
