जवानों आपका एक Certificate और लाखों का नुकसान... जानिए कैसे? | #sainikwelfarenews
In the Indian Army and other defence services, sometimes a single word written on a form decides the difference between lakhs of rupees in loss or lifelong financial security. This video on Sainik Welfare News explains the real impact of the Willing / Unwilling Certificate which every JCO or OR signs at the time of disability, injury, or disease leading to a low medical category (LMC). Many serving soldiers and ex-servicemen do not realise that the choice of “Willing” or “Unwilling” directly controls whether they are treated as Invalided Out with disability pension and OROP benefit or whether they are discharged under Premature Retirement (PMR) rules, which can cut off OROP and in some cases even block service pension if the qualifying service is under 15 years.
The analysis in this episode is based on the Entitlement Rules & GMO 2023, notified on 21 September 2023, and the key pages of this rulebook which specifically mention invaliding from service for JCOs, WOs and ORs. We also cover the role of the Commanding Officer’s recommendations, the shelter appointment system, and how SPARSH / PCDA treat cases of disability when deciding pension and arrears. This information is critical for every soldier, every ex-serviceman, and every family member who depends on defence pension for long-term security.
When a soldier is placed in LMC due to permanent disability, the unit publishes a Part II order (DO II). At that time, the soldier is asked to fill a certificate stating whether he is willing to continue service in sheltered appointment or unwilling to continue. The individual just has to sign with one witness. But this simple choice has massive financial consequences. If the soldier ticks Willing and later the unit cannot retain him due to lack of a suitable sheltered appointment, or the earlier sheltered appointment is withdrawn because the unit moves to field / high altitude area, then discharge is processed as Invalided Out. That means the individual qualifies for disability pension, even if the service is less than 15 years, and also remains covered for One Rank One Pension (OROP) benefits applicable to invalided out pensioners.
If, however, the soldier ticks Unwilling while there was still scope for retention, the system processes the case as Premature Retirement (PMR). In that case, no OROP benefit is given, and if the qualifying service is below 15 years, even service pension may be denied. This is where lakhs of rupees over a lifetime are lost—just because of one word signed on a form.
The Entitlement Rules & GMO 2023 clearly state in Para 5 that JCOs, WOs, and ORs discharged before completing their terms of engagement, but who had expressed willingness to serve, are to be treated as Invalided Out, provided they were released because no suitable sheltered appointment existed or it was later withdrawn. On the other hand, if someone had completed their terms of engagement, was willing, but extension was not granted, then that is not treated as invaliding. This distinction is subtle but extremely important, and most soldiers in the field are not fully briefed about it.
The role of the Commanding Officer (CO) is also central. The CO fills the second half of the certificate with remarks such as:
Willing + No shelter/withdrawn shelter → Invalided Out → Disability pension + OROP.
Unwilling + Shelter available → PMR → No OROP, and if 15 yrs, no pension.
Willing + Shelter available → Continue in service until shelter lasts.
This is not just about paperwork. It is about the dignity of a soldier, his family’s future, and the respect of the nation. Every Jawan, NCO, JCO, and even officers in LMC must know this rule. By choosing “Willing” you keep the door open for invaliding out, which ensures financial security, disability benefits, family pension continuation, OROP arrears, and DA-linked increases for life. By choosing “Unwilling”, you risk being treated as a voluntary PMR case, losing OROP, and in many cases pension eligibility itself.
