If you are behind on your mortgage payments, you have more options than you think, and less time than you think. This video walks through all of them in plain English, then answers the question most homeowners are actually asking: is a short sale the right way out, or is it better to let the foreclosure happen?
No judgment here. Most people facing pre-foreclosure got hit by something they did not choose: medical bills, job loss, hours cut, a failed business, divorce, the death of a spouse. And in Florida, an estimated one third of pre-foreclosures are started by the homeowners association, not the bank.
YOUR LENDER IS LEGALLY REQUIRED TO EVALUATE YOU IN ORDER
The temporary pandemic-era recovery programs expired and were replaced on October 1, 2025 by a permanent set of rules known as the Loss Mitigation Waterfall. Phase 1 is home retention, and your lender must work through it in this order:
1. Early default intervention - a repayment plan, or forbearance pausing or reducing payments up to 12 months
2. Standalone partial claim - the bank bundles what you are behind into a 0% interest subordinate loan with no monthly payment until you sell or pay off the house
3. Loan modification - a permanent change to your terms, targeting roughly a 25% reduction in principal and interest
If none of those make the payment possible, the lender moves to Phase 2, home disposition. That is where a short sale lives.
