There’s growing speculation that the amended decree may override the so-called “minor issue” introduced by the October 3, 2024 circular — which had blocked applicants if their Italian ancestor lost citizenship before their child reached adulthood. Now, under Article 1, paragraph 2, letter c) of the amended decree, the exception reads: «c) uno dei genitori o uno degli ascendenti fino al secondo grado risultava in possesso esclusivo della cittadinanza italiana al momento della nascita del richiedente o al momento della propria morte» “c) one of the parents or one of the ascendants up to the second degree was in exclusive possession of Italian citizenship at the time of the applicant’s birth or at the time of their own death.” This appears to replace the previous requirement that the ancestor maintain citizenship until their child turned 18 — the core of the “minor issue.” While it does not directly repeal the 2024 circular, this new legal standard may effectively override it in practice. Bottom line: If implemented as written, this could reopen eligibility for many applicants who were previously excluded under the minor issue rule.
