Ιατρικό λάθος ή ιατρική αμέλεια; Πότε υπάρχει ευθύνη του γιατρού; Τι σημαίνει πραγματικά ιατρική επιμέλεια; Πότε ένα ιατρικό λάθος μπορεί να θεωρηθεί αμέλεια και πότε ένα δυσμενές αποτέλεσμα αποτελεί απλώς μια γνωστή επιπλοκή ή ένα αποτέλεσμα που δεν μπορούσε να προβλεφθεί ή να αποφευχθεί; Σε αυτό το επεισόδιο εξετάζουμε, με βάση τις γενικές αρχές της ιατρικής και του ελληνικού δικαίου, τη σχέση μεταξύ: • ιατρικού λάθους και ιατρικής αμέλειας • αναμενόμενου επιπέδου ιατρικής επιμέλειας • πράξης και παράλειψης • ιατρικής ευθύνης και αιτιώδους συνδέσμου • ευθύνης του γιατρού και πιθανής ευθύνης ενός οργανισμού ή κλινικής • του ρόλου του ιατρικού πραγματογνώμονα σε υποθέσεις αστικής ευθύνης. Ιδιαίτερη αναφορά γίνεται στη σημασία της αξιολόγησης μιας ιατρικής πράξης με βάση τα δεδομένα και τις συνθήκες που υπήρχαν τη συγκεκριμένη χρονική στιγμή, και όχι μόνο με βάση το τελικό αποτέλεσμα.
