अगर आपको Share Market में Loss हुआ है, चाहे वह Intraday Trading, Futures & Options (F&O), या Delivery में Capital Loss हो, तो सिर्फ नुकसान देखकर परेशान होने की जरूरत नहीं है।
सही Income Tax Planning और Loss Set-Off & Carry Forward की जानकारी होने पर कई मामलों में इस loss का tax planning में फायदा लिया जा सकता है।
इस वीडियो में हम आसान भाषा में समझेंगे कि Intraday Loss, F&O Loss और Capital Loss में क्या अंतर है, इनका Set-Off कैसे होता है, Loss को आगे कैसे Carry Forward किया जा सकता है और ITR Filing के समय किन बातों का ध्यान रखना चाहिए।
1️⃣ Intraday Trading Loss
Intraday trading में खरीदे और बेचे गए shares की delivery नहीं होती। Tax treatment में इसकी nature सामान्यतः speculative business transaction के रूप में देखी जाती है, subject to applicable provisions.
इसलिए Intraday Loss को सामान्य Capital Loss समझना एक बड़ी गलती हो सकती है।

2️⃣ F&O Loss – Futures & Options
F&O Trading करने वाले taxpayers के लिए सबसे महत्वपूर्ण बात है कि F&O transactions का सही tax classification किया जाए।
F&O से होने वाले profit/loss को सामान्यतः business income framework में report किया जाता है, subject to applicable provisions.
इसलिए अगर आपको F&O में loss हुआ है तो उसे सही तरीके से books और ITR में report करना बहुत जरूरी है।

3️⃣ Capital Loss – Delivery Based Shares
अगर आपने shares को delivery के साथ खरीदा और बाद में बेचने पर loss हुआ, तो transaction की holding period और applicable provisions के आधार पर यह Short-Term Capital Loss (STCL) या Long-Term Capital Loss (LTCL) हो सकता है।
Capital Loss को ignore करना सही नहीं है।
Income Tax Department के अनुसार unadjusted capital loss को prescribed conditions के subject to आगे carry forward किया जा सकता है। Short-Term Capital Loss को Short-Term और Long-Term Capital Gains के विरुद्ध adjust किया जा सकता है, जबकि Long-Term Capital Loss को Long-Term Capital Gains के विरुद्ध adjust किया जा सकता है।
4️⃣ Loss को Carry Forward करना क्यों जरूरी है?
मान लीजिए आपको इस साल Share Market में ₹2 लाख का eligible capital loss हुआ लेकिन इस साल पर्याप्त capital gain नहीं है जिससे पूरा loss adjust हो सके।
ऐसी स्थिति में applicable conditions पूरी होने पर remaining loss को future years में carry forward करके eligible capital gains के against set-off किया जा सकता है।
लेकिन इसके लिए Loss Return समय पर file करना बहुत महत्वपूर्ण है।
Income Tax Department के अनुसार capital loss को carry forward करने के लिए जिस वर्ष loss हुआ है, उस वर्ष की return prescribed due date के भीतर furnish करना आवश्यक है। Capital loss को सामान्यतः आठ assessment years तक carry forward किया जा सकता है, subject to applicable provisions.
