Election Commissioners’ Appointment: Should India Change the Selection Process?
Election Commission of India: Should the Appointment Process Be Changed? | SK Live News
How independent is India’s Election Commission, and should the process of appointing Election Commissioners be made more transparent?
In this special news analysis, SK Live News examines the debate surrounding the appointment of Chief Election Commissioner Gyanesh Kumar, opposition demands for accountability, and questions raised over the independence of the Election Commission of India.
On March 2, 2023, the Supreme Court delivered its judgment in the Anoop Baranwal vs. Union of India case. The Court prescribed a three-member committee comprising the Prime Minister, the Leader of the Opposition in the Lok Sabha, and the Chief Justice of India (CJI) until Parliament made a law on the subject.
Parliament subsequently enacted a new law, which came into force on January 2, 2024. Under this law, the selection committee consists of the Prime Minister, a Union Cabinet Minister nominated by the Prime Minister, and the Leader of the Opposition in the Lok Sabha.
This composition has sparked debate because two of the three members represent the government, potentially giving it a majority in the selection process.
The programme also discusses allegations raised by opposition parties and protesters regarding changes to voter lists and the Special Intensive Revision (SIR). These remain allegations and should not be treated as established wrongdoing without supporting evidence.
Key questions discussed in this programme:
How are India’s Chief Election Commissioner and Election Commissioners appointed?
What did the Supreme Court decide in the Anoop Baranwal case?
What changed under the 2023 appointment law?
Does the government’s majority on the selection committee raise concerns?
Should the Chief Justice of India be included again?
How can transparency, accountability and public trust in the appointment process be strengthened?
The independence of the Election Commission is an important part of a healthy democracy. The aim of this discussion is to examine the existing system, consider possible reforms, and encourage an informed and balanced public debate.

What would strengthen the appointment process: the existing selection committee, the inclusion of the CJI, or another transparent mechanism?
