VA presumptive service connection is not automatic. When its conditions are met, a presumption supplies the link between a listed condition and service — but your VA disability claim evidence still has to address the rest.
In this lesson from The Evidence Blueprint series, we break down what a presumption actually supplies, the questions it still leaves open, and how to sort your own evidence against those questions. We also cover what happens when a presumption doesn’t fit, and why that isn’t automatically the end of the analysis.
You’ll learn:
• What a presumption supplies, and what it doesn’t
• The four questions: which presumption, which service, which condition, which window
• Why presumptions aren’t all alike, and why identifying yours comes first
• Why a diagnosis inside the window isn’t what the regulation asks for
• Why "not on the list" sends the relationship question back to the direct pathway instead of ending it
Free resource for this lesson: the Evidence Blueprint Workbook includes a Presumptive Pathway worksheet to sort the evidence you already have under each question. Get it at VeteranClaimsMadeEasy.com.
This is Lesson 10 of 13 in The Evidence Blueprint. It builds on Lesson 1 (the four-question framework), Lesson 8 (organizing evidence by the question it answers), and Lesson 9 (secondary claims).
Regulations referenced: 38 CFR 3.303(d), 3.307(a)–(d), 3.320. Presumptive lists are set by law and regulation and can change. This video teaches the questions, not the lists.
