WHAT IS ONE TIME SETTLEMENT (OTS)?
One Time Settlement, commonly known as OTS, is a process through which a lender may agree, subject to its policies and the facts of the case, to accept an agreed amount toward settlement of outstanding dues. OTS is not an automatic right of every borrower, and its availability, eligibility, settlement amount and terms can vary from lender to lender and case to case.
An important point discussed in this video is that OTS should NOT be treated as an easy way to avoid repaying a loan.
If you have the financial capacity to repay your loan according to the agreed terms, repayment should generally remain the priority. Loan settlement may have serious financial consequences, including an adverse impact on your credit history and your ability to obtain loans or credit cards in the future.
OTS should generally be explored only when a borrower is facing genuine financial hardship and is unable to repay the outstanding debt despite reasonable efforts. Before accepting any settlement, carefully understand the lender's written terms, the amount payable, credit bureau reporting implications and whether the account will be reported as “settled,” “closed,” or under another applicable status.
This video also explains the difference between secured and unsecured borrowing. Home loans, car loans and gold loans generally involve security/collateral, whereas personal loans and most credit card dues are generally unsecured. Therefore, the recovery process and consequences of default can differ significantly depending on the type of credit facility.
If you are struggling with a Home Loan, Car Loan, Personal Loan, Credit Card outstanding, KCC Loan or Gold Loan, do not ignore communications from your lender. Understand your repayment position, communicate with the bank or financial institution and explore legitimate options such as restructuring, repayment arrangements or settlement where applicable.
DISCLAIMER :
This video is created strictly for educational and informational purposes only. Nothing discussed in this video should be considered financial, legal, investment, credit or professional advice.
Loan recovery, One Time Settlement (OTS), legal proceedings, asset enforcement, credit bureau reporting and other consequences of default depend on several factors, including the type of loan, loan agreement, security/collateral, lender policies, applicable laws and regulations, and the individual circumstances of the borrower.
OTS or loan settlement is NOT guaranteed and should not be interpreted as a method to intentionally stop loan repayments or avoid legitimate debt obligations. We do not encourage wilful default, deliberate non-payment, concealment of assets, misrepresentation or misuse of the loan settlement process.
Before making any decision regarding loan default, settlement, restructuring, repayment or any legal matter, borrowers should contact their bank/NBFC and, where necessary, consult a qualified financial or legal professional.
The information presented in this video is general in nature and may change with amendments in laws, regulations, lender policies and regulatory guidelines.
