Section 319 CrPC | Can Court summon in casual and cavalier manner | Supreme Court Latest Judgment | SOURCE- Judgment delivered by the Hon'ble Supreme Court Recently the Supreme Court held that the Magistrate or the Seasons Judge can't use exercise the power under Section 319 Crpc in a casual and cavalier manner to issue summons to other person in case which the Court is of opinion that he is guilty of the offence. To exercise the power of Section 319, there must be more than a prima facie case against him and strong and cogent evidence which should be against him.
