Art. II, Sec. 5 - Police Power of the State

Police power is the State’s primary tool to secure the welfare of its people. It authorizes restraint on liberty and property, but only when exercised for a lawful subject and through lawful means. Our jurisprudence demonstrates both the necessity and the dangers of this power—upholding reasonable regulations while invalidating oppressive ones. Ultimately, it is the heartbeat of constitutional governance: balancing freedom with responsibility, and individual rights with the collective good.
