In June, the Supreme Court sided with a man charged with having a firearm at home while using marijuana, and every justice agreed on the result. But the Court threw out his charge, not the law: the federal ban on firearm owners who unlawfully use marijuana is still on the books, the Court called its ruling narrow, and the federal firearm form still asks about marijuana. We walk through what United States v. Hemani actually decided, what ATF's own rules say an "unlawful user" is, where the proposed new firearm form stands, and the two big questions the Court left open: medical card holders and hemp THC after December 11.
This is news, not legal advice. If any of this applies to you, talk to a firearms attorney before you buy.
