Tinubu’s Vacation Extension Raises Section 145 Debate: Who Is In Charge?

President Bola Tinubu’s extended stay abroad has renewed debate over Section 145 of Nigeria’s 1999 Constitution and the requirements for presidential absence. The President left Nigeria on August 30 for what the Presidency described as a three-week working vacation, with officials saying he is expected back at the weekend. Section 145 requires the President to transmit a written declaration to the Senate President and Speaker of the House when proceeding on vacation or unable to perform his duties, and provides for National Assembly action if the declaration is not transmitted within 21 days. The Presidency says Tinubu remains in charge and continues to communicate with government officials, while Vice President Kashim Shettima represents Nigeria at the 81st UN General Assembly in New York.
