The bail application of suspended Deputy National Police Commissioner Lieutenant General Shadrack Sibiya reached its closing arguments at the Randburg Magistrate’s Court, and judgment has been reserved.
Reading from the investigating officer’s sworn statement, the state told the court that Sibiya was very angry when he was arrested and said: “I have dealt with the commission. I have dealt with 121 dockets and I thought I have won.” The state presented this as evidence of resentment toward the man who had named him.
From the same statement, the state said that when a separate search warrant was executed, Sibiya told officers he knew his phones were being intercepted, kept changing his numbers and threw the old ones away. It also said it holds statements that phones he used around the time of the alleged offence were wiped on his instructions. None of this has been tested at trial.
The state argued that letters his attorney sent to the NDPP before any charge were mainly an attempt to avoid his arrest, while the attorney had said he was protecting Sibiya’s rights. If people with deep pockets could avoid arrest that way, the state said, it would open “a can of worms.” On why the complainant went to the Madlanga Commission’s task team rather than a local police station, the state said there was “nothing sinister” in it.
Sibiya’s defence replied that the court should not “descend into the arena,” argued that legislation giving jurisdiction to a particular unit had been bypassed, and warned that “the justice system will fall in total disrepute if we start disregarding legislation.” It pointed to IPID as the body “specifically geared at policing police.”
Judgment is set for Tuesday, 20 October 2026. Sibiya remains in custody.
This bail application concerns serious criminal charges, including rape and human trafficking, which this video does not detail.
