Enron used its own stock as the collateral protecting it from its own bad bets. The entities were called the Raptors, and they only worked as long as Enron's share price kept climbing.
A historical documentary built from public records. Not investment analysis or financial advice.
In this episode: the SEC's January 1992 approval letting Enron use mark-to-market accounting on twenty-year gas contracts with no outside market to check the price against; Andrew Fastow's off-the-books partnerships, Chewco and LJM, and the Raptor entities that used pledged Enron stock to hedge Enron's own mark-to-market losses; Sherron Watkins' August 15, 2001 memo to Kenneth Lay; the November 8, 2001 8-K restating four years of earnings; the December 2 Chapter 11 filing with $63.4 billion in assets; Arthur Andersen's 2002 conviction and its 2005 Supreme Court reversal; Andrew Fastow's guilty plea; and Kenneth Lay's 2006 conviction, vacated after he died before sentencing.
We kept the documented apart from the disputed. Mark-to-market was not invented by Enron and is not, by itself, fraud. Whether Kenneth Lay fully understood the risk Sherron Watkins described is a question the surviving record does not settle. We found no reliable aggregate figure for total employee retirement losses and did not invent one.
