#PoliceBodycam #DUI #LegalAnalysis A concerned civilian takes action after finding an apparently impaired driver stopped in the middle of the road and blocking traffic. The woman tells police she saw the driver struggling to operate the vehicle and repeatedly attempting to drive away. Believing she was unsafe to continue, the civilian moved the vehicle out of traffic, took the driver’s keys, and called police. When officers arrive, they observe signs of significant impairment. The driver says she has been sober for nearly four years, but officers also discover small Fireball whiskey bottles inside the vehicle and begin a DUI investigation. At first, one officer considers contacting the driver’s family and allowing them to take her home rather than sending her to jail. But after the driver repeatedly struggles to understand and follow basic sobriety-test instructions, the officer changes course and places her under arrest. In this legal analysis, we examine civilian intervention, DUI investigation, probable cause, field sobriety testing, officer discretion, and the legal issues surrounding an impaired driver stopped in active traffic.
