Judge Hears Mitigating and Aggravating Factors for Tomasz Kosowski's Sentencing

SPENCER HEARING- Sentencing set for November 20, 2026. Former plastic surgeon Tomasz Kosowski was found guilty of first-degree murder in the 2023 killing of attorney Steven Cozzi. Cozzi’s body has never been found. Kosowski represented himself, waived a jury, and was convicted by Pinellas County Judge Joseph Bulone on September 23, 2026. Prosecutors are seeking the death penalty. The judge found two aggravating factors proven beyond a reasonable doubt — financial gain, and that the murder was cold, calculated, and premeditated — but rejected the heinous, atrocious, or cruel aggravator because the exact manner of death could not be proven without a body. On October 8, 2026, the court held a Spencer hearing, the final step in Florida capital cases where additional mitigation and argument can be presented before sentencing. Kosowski again waived counsel and declined to present mitigation. Because Kosowski refused to present any mitigation himself, Judge Bulone appointed special counsel John Nohlgren to put some on the record anyway. Judge Bulone did not impose a sentence that day and set formal sentencing for November 20, 2026 at 1:30 p.m. ET.
