Andrew Griffin Trial Day 8 - VERDICT!
On Day 8 of State of Ohio v. Andrew Griffin, the judge gives the jury its final instructions on the law. The jury then deliberates and returns verdicts.
The judge defines “knowingly” as it applies to aggravated arson. He explains how to complete the verdict forms for each of the five counts:
Counts 1 and 2: aggravated murder of Angela Joe Strussian and Thomas Deed Strussian.
Counts 3 and 4: aggravated murder of each victim while committing, attempting to commit, or fleeing after trespass in a habitation when a person is present or likely to be present.
Count 5: aggravated arson.
Firearm specifications attach to Counts 1 through 4.
He tells the jurors that all 12 must agree on every verdict, and that they may not consider punishment. He also tells them to choose a foreperson, to deliberate openly without giving up their honest convictions, and to put any questions to him in writing. They may take their notes into the jury room.
The two alternate jurors, Jurors 82 and 86, are thanked and released, and the 12 jurors begin deliberating. Outside the jury’s presence, the court and both sides confirm the exhibits and verdict forms that go to the jury room: physical exhibits, a binder of printed documents, and a drive of digital evidence.
When the verdicts come in, the judge thanks the gallery for its conduct and asks that it continue during the reading. The jury finds Andrew Griffin guilty on all five counts and finds that the State proved every firearm specification beyond a reasonable doubt. Each of the 12 jurors is polled and confirms the verdicts.
The judge thanks the jury for its service. He orders a pre-sentence investigation and a victim impact statement, and sets sentencing for Tuesday, December 1 at 1:30 p.m. Griffin will remain held without bond. The judge explains Griffin’s right to make a statement in the pre-sentence report and again at sentencing.
