Gifting a property is not automatically tax-free. For IHT, a lifetime gift will generally be a Potentially Exempt Transfer, with the seven-year rule potentially relevant. If the parent gives away their home but continues living there without paying an appropriate market rent, the gift-with-reservation rules can mean the property remains within their estate. For CGT, transferring property to a child can be treated as a disposal at market value, although Private Residence Relief may be available where the property qualifies as the donor's main residence. For SDLT, a genuine gift with no chargeable consideration will normally not create an SDLT liability. However, taking on an outstanding mortgage can constitute chargeable consideration, potentially changing the SDLT position.
