The Western Cape High Court continues hearing President Cyril Ramaphosa’s application to set aside the Independent Panel’s Phala Phala report and the parliamentary steps flowing from it. The case turns on what “sufficient evidence” means at the preliminary stage of a section 89 process. President Ramaphosa argues that the Panel applied the wrong legal test and relied on material that could not lawfully support its conclusions. The opposing parties argue that the Panel was only deciding whether there was a case to answer—not conducting the impeachment inquiry itself.
