Thousands of affirmative asylum applicants are noticing a new message in their USCIS accounts: instead of “Next Step Is an Interview,” the system now says the next step is “Adjudication.”
Does that mean USCIS will skip the interview? Does it mean the case is being denied or sent to Immigration Court? In this video, we separate the website change from the July 2026 rule that allows certain affirmative asylum cases to be referred to EOIR without an interview.

This is an important update for people with affirmative asylum applications pending with USCIS.
Over the last several days, many applicants have opened their USCIS accounts and noticed that the wording has changed.
Before, the case status often said: “Next Step Is an Interview.”
Now, many accounts say the next step is “Adjudication,” and that if USCIS schedules an interview, the applicant will receive an interview notice.
So what exactly is happening?
First, the website wording by itself does not mean your asylum case has been denied. It also does not mean that USCIS has already referred your case to Immigration Court.
But there is an important legal change behind the concern. Since July 28, 2026, DHS regulations allow USCIS to refer certain affirmative asylum applications to Immigration Court without first conducting an asylum interview.
USCIS still must interview an applicant before USCIS itself grants or denies asylum. But referral is different. In an appropriate case, USCIS can now send the asylum application to EOIR without first interviewing the applicant.
What could happen next?
● USCIS may schedule an asylum interview.
● USCIS may continue reviewing the file.
● For certain applicants, USCIS may refer the asylum case to Immigration Court without an interview.
Important: The new “Adjudication” message does not, by itself, tell us which of those paths USCIS will take in your individual case.
If you receive an interview notice, prepare for the interview. If you receive an NTA or referral notice, do not assume the asylum claim is over. An Immigration Judge can independently hear the asylum application in removal proceedings.
For now, check your USCIS account, keep your address updated, watch your mail carefully, and make sure the evidence in your asylum case is organized and current.
