On January 3, 2024, at Seattle Tacoma International Airport, a Delta Air Lines pilot reported that a fellow arriving passenger shoved him on the escalator into customs, then came up behind him in an empty hallway and threw a shoulder into him. Port of Seattle police located the passenger, a traveler from Los Angeles, who said the pilot had been staring at him and looking at his information. He was told he was "technically under arrest for assault," fingerprinted, photographed, and released. According to police records cited in the original footage, he was issued a criminal citation and charged with fourth degree assault.
This breakdown covers RCW 9A.36.041, Washington's definition of assault as an offensive touching, RCW 10.31.100, Miranda v. Arizona, and Berkemer v. McCarty.
Can a shoulder bump with no injury be a crime? Could officers arrest for an offense they never saw? Was the passenger's "oh well yeah" a custodial admission made without warnings?
