EXCLUSIVE INTERVIEW WITH JACOB ROTH- ON EFFICIENT JUDICIAL PRE-TRIALS & JUDICIAL PRE-TRIAL MEMOS

One of the preliminary steps in a criminal matter is the judicial pre-trial commonly referred to as JPT. A JPT can be an important opportunity to discuss various issues about a criminal case and also a unique opportunity to resolve a matter. Written submissions for a JPT can be a very powerful and effective tool, but not all lawyers engage in this practice. In this exclusive interview I chat with defence lawyer Jacob Roth about the importance of JPT memos and preparing submissions for an effective JPT. We talk about what to include in the a JPT memo, how many JPTs should be held if resolution is the goal. How to deal with the Crown who does not change positions following JPT discussions, to how to deal with a client if a JPT outcome is not what a client is expecting. Jacob Roth is an associate in the criminal practice of Henein Hutchison Robitaille LLP. He has represented clients before all levels of court in Ontario, administrative tribunals, and professional regulatory bodies.   Before joining Henein Hutchison Robitaille LLP, Jacob practiced at a Toronto-based criminal defence firm, where he focused on defending against sexual assault allegations.   Jacob received his law degree from the University of Toronto in 2018. During law school, Jacob worked at a civil litigation firm and supported the lawyers in several high-stakes medical malpractice matters.   After graduating from law school, he articled with the in-house litigation team at the Centre for Addiction and Mental Health (CAMH).
