Swabs from the log at the center of this trial went to the crime lab. The jury hears what the lab found, and what it never could.
This is the Buried Beneath the Snow Trial in Wisconsin. Timothy Hauschultz, great-uncle and guardian of 7-year-old Ethan, is charged in Ethan's death in April 2018 and has pleaded not guilty. The State says he ordered the punishment of carrying a log. He was not home when it was carried out.
Weigh this: the log the State ties to Ethan gave the lab too little DNA to go any further, and in 2023 its evidence envelope was found damaged. And three times that afternoon, the home phone called a number identified as his. Watch what each side makes of them.

0:00:00 What this video is, and a preview
0:00:17 to 0:18:02 - Video starts: Back on the record after the break. The jury returns, and the State calls a DNA analyst from the state crime lab.
0:18:02 to 0:23:16 - The swabs from the ground near the log: the DNA was Ethan's, a profile the lab put at rarer than one in seven trillion.
0:23:16 to 0:24:31 - The 2021 round, swabs and wood scrapings from a log. Testing stopped early: "no DNA detected or limited DNA detected."
0:24:31 to 0:26:05 - Is DNA always there? It depends how evidence is stored and packaged: "a whole bunch of conditions" can damage it.
0:26:05 to 0:27:43 - The defense cross, short: no DNA from the log samples, and "blood was not detected on either of the logs."
0:27:43 to 0:30:25 - A retired sheriff's lieutenant takes the stand: 27 years with the Manitowoc sheriff's office, called back in that night.
0:30:25 to 0:33:04 - He weighed the log Ethan reportedly carried. A hearsay objection, the judge lets him answer: "44.4 pounds."
0:33:04 to 0:34:28 - 2021: he swabs and scrapes that same log, looking at spots with "a reddish tint to it."
0:34:28 to 0:36:23 - The defense: in 2023 that log's envelope was damaged, with water "leaking in through the roof." The State: that was 2023.
0:36:23 to 0:42:22 - Major Oswald of the sheriff's office: that night he sat by Ethan at the hospital, then kept the children from talking before their interviews.
0:42:22 to 0:43:59 - The home phone that afternoon: calls to the phone identified as Timothy's at 1:47, 2:24 and 3:13 p.m.
0:43:59 to 0:47:08 - What a 911 call would have brought: township first responders who can "help render aid" before an ambulance arrives.
0:47:08 to 0:49:25 - The defense: volunteers. Who was free that day, and would they beat the drive to the hospital? "I wouldn't have that answer."
0:49:25 to 0:50:51 - Redirect: first responders "typically are on scene first." Recross: still no way to know they would have been faster.
