The Supreme Court refused to stop the protest. Delhi Police detained the protest organiser hours later. Who decides the limits of the right to protest? Today, Justice Joymalya Bagchi summed up the conflict in one striking observation: “Someone wants to protest, someone wants to sell moongfali, someone wants to maintain law and order. All these are related.” Hearing a plea by traders seeking to stop the “Lehra Do Tiranga” march at Connaught Place, the Supreme Court declined to intervene, leaving the matter to the Delhi High Court. CJI Surya Kant acknowledged the difficulties small shopkeepers could face during the festive season, while the Bench said any disproportionate loss could be addressed through compensation. But hours later, at around 4:54 PM, Delhi Police detained Cockroach Janta Party’s Abhijeet Dipke as he was leaving home for Connaught Place. Police had reportedly offered to allow just 11 people to gather at Central Park, even as the park remained closed and prohibitory restrictions were in force. AISA’s Neha Bora was also reportedly detained during a Tricolour march from Mandi House. The development raises serious questions about the relationship between judicial directions, police powers and the constitutional right to peaceful assembly. Meanwhile, Delhi’s Chief Electoral Officer reportedly said that 47 lakh voters removed from the draft electoral roll were undergoing re-verification, adding another dimension to the controversy surrounding the SIR process. The concerns on both sides matter: traders have a legitimate interest in protecting their livelihoods, while peaceful protesters have rights that must be considered within the law. If the Supreme Court declines to impose a pre-emptive ban, how should police restrictions be assessed? And who should be accountable when restrictions prevent a protest from taking place?
