The investigator says the uncle on trial was interviewed over seven or eight times, he believes. He tells the jury none of the actual interview has been played. Then the State rests.
This is State of North Carolina v. David Wesley Prevatte in Pender County. David Prevatte is the uncle accused in the death of his five-year-old niece, Paitin Fields. He says he found her and tried to save her, and he is presumed innocent. On Day 7, Investigator Eric Short, who reviewed the unsolved file and made the arrest in 2022, finishes his cross-examination by Luther Johnson Britt III. Melinda Wilson, a forensic scientist, follows him as the State's last witness.
Watch the fight over a single question. Britt asks whether anything his client told detectives has been presented in this courtroom, the State objects, and the jury is sent out while the court rules. When the jury returns, Short answers: "None of the actual interview has been played, no sir." Then follow Wilson's two lab reports: who is excluded, and what carried too little DNA to test.
With the jury out, the State tells the court it has elected not to put his statements in. What should a jury do with statements it has not heard? After the State rests, the defense's motion to dismiss turns on one of three charges, and the court takes it under advisement. Is what the State put on enough? Only the jurors decide.
