The State's outside DNA lab told the Uncle on Trial jury it could draw no conclusions from its testing. Then came the investigator who took the file in 2020.
This is Day 7 of State of North Carolina v. David Wesley Prevatte in Pender County Superior Court: the trial of the uncle charged in the 2017 death of his five-year-old niece, Paitin Fields. He was named a suspect in 2018, was not charged until 2022, and is presumed innocent. Two State witnesses fill this Part. Lyndsey Sanney is a senior DNA analyst at Bode Technology, the private lab that tested extracts sent on by the State crime lab. Investigator Eric Short picked up what he calls an unsolved case in October 2020, after the first detective had retired.
Watch what the defense does with the lab's own numbers on cross. Then follow Short's direct in the order he builds it: the search history in one account, a belt he sets aside, a shape he says he saw in the photographs, and the one item in custody that, in his opinion, fits it. Court breaks with Short still on direct, so his cross comes in the next Part.
The question this Part leaves is the one the State put to its own witness: was his mind made up when he opened the file? Short says a suspect had been developed before he ever read it, and that he came to it with "a fresh set of eyes." Whether those eyes found something new, or found what the file already pointed to, is for the jurors to weigh. You can weigh it here.
