वडिलोपार्जित संपत्तीत मुलींना हिस्सा I सर्वोच्च न्यायालयाचा निर्णय I

‪@advocatepramoddhokale‬ subscribe this channel    / @advocatepramoddhokale   या व्हिडिओ मध्ये सर्वोच्च न्यायालयानं मुलींना संपत्तीत सामान अधिकार देणाऱ्या निर्णयाची सोप्य्या भाषेत माहिती दिली आहे. हिंदू वारसाहक्क कायद्यातील कलाम ६ चा चुकीचा अर्थ २०१६ च्या प्रकाश वि फुलवती खटल्यात लावला होता. तो निर्णय आता रद्ध केला आहे. यामुळे देशातील अनेक या विषयावरचे खटले ६ महिन्यात निकाली निघतील. मुलींना मिळालेला‪@advocatepramoddhokale‬ co-parcenery म्हणजे सहभागीदारीचा हक्क वडिलांच्या जीवित असण्यावर अवलंबून नाही. यालाच unobstructed वारसा हक्क म्हणतात. मिताक्षरा संहितेनुसार कॉपर्सनेरी हक्क हा unobstructed आहे. यामुळे २००५ साली जिवंत असलेल्या मुलींना त्यापूर्वी वाटणी झालेल्या संपत्तीत आपला हक्क मागता येईल. Latest decision of Supreme Court has clarified the position of Hindu Succession Act 2005. Daughters were given co-parcenery rights in ancestral property of Hindus. However the exact time and manner in which this right can be exercised was in dispute. This happened due to the conflicting decisions given by the SC in two different cases.
