How Do You Transfer a Property Title to a Family Member in New York? by Peter Zinkovetsky
Deed transfer NY attorney Peter Zinkovetsky of Avenue Law Firm explains how to transfer a property title to a family member in New York, covering deed types, recording requirements, and tax obligations.
Transferring property to a family member in New York requires selecting the right deed, completing state and city transfer forms, paying applicable taxes, and recording the deed with the correct county clerk or City Register office. New York recognizes three main deed types for family transfers: a quitclaim deed, which conveys whatever interest the grantor holds without title warranties; a bargain and sale deed, which may include a limited covenant against the grantor's acts; and a full covenant and warranty deed, which offers the broadest contractual protections by promising the grantor holds clear title and will defend against covered claims. Every deed must accurately name the grantor and grantee, include the property's legal description, be signed by the current owner, and have the signature acknowledged by a notary public before recording.
The recording package varies by location. Properties outside New York City require Form RP-5217 (Real Property Transfer Report) and Form TP-584 (Combined Real Estate Transfer Tax Return), plus any county-specific disclosure forms. Transfers in Manhattan, Brooklyn, Queens, or the Bronx are processed through ACRIS, which generates the cover pages, recording documents, and NYC Real Property Transfer Tax returns. Staten Island properties are unique: ACRIS generates the RPTT tax forms, but the deed and payment must be submitted directly to the Richmond County Clerk rather than processed electronically through the City Register. Once the full package is filed, the public record is updated and the new owner is protected from competing claims.
Even no-money transfers carry significant tax exposure. Transfers for less than fair market value may require the donor to file federal Form 709 and can reduce the donor's lifetime gift and estate tax exemption. Recipients of gifted property inherit the donor's adjusted cost basis, which can trigger substantial capital gains tax on a future sale. Inherited property, by contrast, typically receives a stepped-up basis tied to fair market value at the date of death. New York also offers a transfer-on-death deed for owners who want to pass real estate outside probate.
