“He’s Just a Guest!” — What California Landlords Can Do About Unauthorized Occupants

TENANT MOVED SOMEONE IN WITHOUT PERMISSION? What happens when your rental agreement lists one tenant—but someone else appears to have moved into the apartment? The tenant may say, “He’s just a guest.” But if that person is regularly staying overnight, parking at the property, coming and going every day, or creating problems for other tenants, a landlord may be dealing with an unauthorized occupant. If an unauthorized-occupant issue eventually becomes a contested eviction, the landlord may need to prove that the person was actually residing at the property and that the rental agreement was being violated.
