*“If you are not conscious of these responsibilities, then you should not be acting as a YouTuber or commentator in the first place.”* The Delhi High Court made a significant observation during the hearing of YouTuber *Ajeet Bharti’s anticipatory bail plea* in an SC/ST Act case. Justice Saurabh Banerjee stressed that a YouTube commentator must understand *who they are, the platform they are using, the context in which they speak, and the impact of their words.* The Court also observed that while there may be no formal rulebook governing YouTube commentators, the absence of professional qualifications or institutional regulation makes it even more important for creators to understand the responsibility attached to the platform. The case concerns an FIR registered under **Section 3(1)(r) of the SC/ST Act**, relating to remarks allegedly made during a YouTube broadcast concerning Nagina MP Chandrashekhar Azad. Bharti’s counsel argued that the alleged remarks were made in a moment of provocation, were not intended to insult any caste, and that the statutory requirements of the SC/ST Act were not satisfied. The prosecution, on the other hand, argued that the context, public nature of the remarks and other circumstances warranted the application of the Act. The Court also declined to have the allegedly offensive words repeatedly reproduced in open court, observing that they were already part of the record and did not need to be circulated further. The Court has *reserved its order on the anticipatory bail plea* and has, at this stage, **declined interim protection**.
