WHO HAS THE LEGITIMATE AUTHORITY TO LEAD A POLITICAL PARTY WHEN TWO FACTIONS CLAIM ITS PRESIDENCY? | PFP v. COMELEC | G.R. NO. 276456
When two factions claim leadership of a registered political party, who determines which officers have the legal authority to represent it? The Supreme Court clarified that the Commission on Elections (COMELEC) may resolve intra-party leadership disputes when necessary to determine the legitimate officers of a registered political party.
In Partido Federal ng Pilipinas v. Commission on Elections, G.R. No. 276456, February 25, 2025, the Supreme Court denied the petition and affirmed the COMELEC’s recognition of the leadership headed by Reynaldo S. Tamayo, Jr.
The dispute arose when Leandro B. Verceles, Jr. and Antonio C. Rodriguez, Jr. claimed that the incumbent officers’ terms had expired under the party’s 2018 Constitution and By-Laws. However, the COMELEC found that the party’s 2022 Constitution and By-Laws, which prescribed three-year terms, remained controlling. The rival faction’s purported election on December 14, 2023, also failed to comply with the requirements for proper notice, authority to convene, and quorum. Its Sworn Information Update Statement was likewise filed beyond the prescribed deadline.
The Court found no grave abuse of discretion in the COMELEC’s findings. It emphasized that political-party leadership must be determined according to the governing party constitution and by-laws, valid internal procedures, and applicable regulatory requirements.
TLG LEGAL INSIGHT: Competing claims to party leadership do not determine legal authority. The prevailing constitution and by-laws, validly conducted meetings, quorum requirements, and timely COMELEC filings are essential in establishing which officers may legitimately represent a registered political party.
