He saw a mark on her, and his report on the Tyreek Hill call says there was no physical contact. Now Keeta Hill's lawyer reads it back to him.
This is Day 5 of Lakeeta Hill v. Tyreek Hill, the civil jury trial in Miami-Dade over what happened behind closed doors during an 18-month marriage. Keeta Vaccaro Hill is the plaintiff. She says there were eight incidents. Tyreek Hill denies every one of them, and these are allegations, not findings. Nobody is charged with a crime in this courtroom. The jury is deciding liability, and the fight is her account now against the records made back then.
Officer Cuellar wrote one of those records. He is Tyreek Hill's witness, the primary officer on the call, and he has already told this jury why he made no arrest. Earlier in this same cross he said how long he had been working by himself when he wrote the report: "On my own, a week." This clip is the back half of that cross, where her lawyer walks through his report section by section.
It starts with the mark. He agrees he saw one, and then he agrees with the next question too: "you put in your report that there was no physical contact, right?" Then the gaps. Five people were there, and his report lists two. He took no statements from Tyreek Hill's parents. The property section, where video would be logged, is blank. "There's nothing here." Did he ask whether there was any video? No.
Then the two words this cross was built around. The report says that when he asked her about the mark, she said it probably happened "without malice." Her lawyer asks whether she said that. Officer Cuellar tells the jury the phrase was his own, his way of writing down what he took from both of them: "without bad intentions, without maliciousness, without ill will." The last question of the cross asks him whether he added words she did not say. Listen for the one word he gives back.
Be fair to the officer. He says he does his own investigation and asks what the situation calls for, and he says both parties told him "the argument never became physical." But Tyreek Hill's defense leans on the records made at the time, and a police report is the kind of record a jury trusts. So here is what this cross puts in question: how much of that report is what people said to him, and how much is his own summary in his own vocabulary? Asked whether the questions he skipped are required, he says no. Then his deposition answer is read back to him: "I think that's part of the process, yes, sir." I am not the jury and neither are you. Only those jurors decide what this report is worth.
