BJP का 56% आरक्षण रद्द, कोर्ट ने धज्जियां उड़ा दी! SC ST Reservation | BJP | General | Modi | OBC
The Karnataka High Court has delivered a major verdict on reservation.
The court has struck down a state law that increased reservation for Scheduled Castes and Scheduled Tribes. It held that the overall reservation limit cannot exceed 50%, and that Karnataka’s law violated this ceiling.
Here is what happened.
In 2022, the then BJP government introduced a law to increase reservation for SCs and STs.
Under this law, the total reservation for SCs, STs and OBCs in the state was increased from 50% to 56%.
However, the High Court has now declared two key provisions of this law unconstitutional and struck them down.
The court held that these provisions violated Articles 14, 15 and 16 of the Constitution.
The Supreme Court had established the general 50% reservation ceiling in the 1992 Indra Sawhney case. Although the possibility of exceeding this limit in exceptional circumstances has remained a subject of legal debate, the Karnataka High Court found that the state’s law did not meet the constitutional requirements.
The law had been challenged in court by petitioners who argued that the decision to increase reservation was not in accordance with the Constitution.
Let’s understand how reservation in Karnataka reached 56%.
Earlier, Scheduled Castes, or SCs, were entitled to 15% reservation, while Scheduled Tribes, or STs, received 3%.
In 2022, the BJP government led by then Chief Minister Basavaraj Bommai decided to increase these quotas.
The SC quota was raised from 15% to 17%, while the ST quota went up from 3% to 7%.
This meant that the combined reservation for SCs and STs increased from 18% to 24%.
Now add the 32% reservation already provided to OBCs, or Other Backward Classes.
The total reservation in Karnataka therefore rose from 50% to 56%.
Now that the High Court has struck down the relevant provisions and ruled against exceeding the 50% ceiling, let’s look at how upper-caste voices on social media are reacting to the verdict.
One user wrote that they had assumed the decision would concern the current Congress government in Karnataka, only to discover that the law in question had been introduced by the previous BJP government.
Another user criticised what they described as caste-driven, anti-upper-caste politics, arguing that reservation had created disorder in the country. The user also complained that issues such as education, healthcare, roads, electricity, water, employment and development were being neglected while caste-based reservation continued to dominate the political debate.
Someone else compared the Karnataka case with Madhya Pradesh, where the BJP has been pushing for a higher OBC quota. The user pointed out that Chief Minister Mohan Yadav had been holding discussions in Delhi, while the Congress was supporting the demand.
Another user questioned why political leaders continued to push for higher reservation quotas for electoral gains when courts had repeatedly referred to the 50% ceiling.
Meanwhile, the Congress government in Karnataka has also responded to the High Court’s verdict.
Deputy Chief Minister G. Parameshwara described the decision as serious, saying it could affect social justice and opportunities in education and government employment.
He questioned the role of the previous BJP government and called on the central government to undertake a comprehensive review of the 50% reservation ceiling.
Parameshwara also said the government would consider seeking inclusion of Karnataka’s reservation law in the Ninth Schedule of the Constitution.
The state government has indicated that it will explore all available legal options, including filing an appeal in the Supreme Court.
Now let’s look at the BJP’s response.
Former Chief Minister and BJP MP Basavaraj Bommai has called on the Congress government in Karnataka to challenge the High Court’s verdict in the Supreme Court.
Bommai also warned that he would approach the Supreme Court himself if the state government failed to do so.
Defending the previous BJP government’s decision, Bommai said the increase in reservation had been based on the report of the Justice Nagamohan Das Committee. He also pointed out that the decision had been passed by both the state Legislative Assembly and the Legislative Council.
