BAM’s WILD New Theory: Is the BAM Map Secretly Reckless Ben?! (Emergency Filing LIVE)

BAM filed an “emergency” motion at the last minute, and now they’re hinting that the BAM Map might be Reckless Ben. BAM's arguments get more desperate and pathetic with each filing! On Friday, November 6, BAM Franchising filed an Emergency Ex Parte Motion for Leave to File a Supplemental Memorandum (Dkt. 38) in BAM Franchising v. Does 1-10 (D. Utah). That’s the lawsuit to unmask whoever runs thebammap.com. The Court has set the Publisher’s motion to quash for hearing on November 10. BAM wants the judge to consider twelve new BAM Map posts before then. Those posts include Ammon McNeff’s “82% to 83%” correction, franchisees calling a fellow owner’s bulk-lot offer “predatory,” and the Google branding problem that owners say still wasn’t fixed. BAM’s arguments: the Publisher’s speech can’t be “chilled” because it kept posting. The Publisher could now be named as a defendant for “aiding and abetting.” And BAM can’t rule out that the Publisher is acting in concert with Ben Schneider under the Reckless Ben preliminary injunction. BAM cites the part of the injunction that bars soliciting leaks. It skips paragraph 2, which expressly protects publishing court filings, investigative journalism, and commentary.
