Testimony of defense witness Paramedic Daniel Stark in the Phil Spector trial regarding Lana Clarkson's 2001 Hollywood Hills fall and whether she was under the influence:
Jackson Closing on Stark's Credibility
• Memory critique: Six years later, no notes or reports, thousands of calls since, yet he remembers she was drunk.
• Written records: EMS report and base hospital form both say not under the influence, no ETOH.
• Radio tape: Senior partner Bruce Liverpool tells the base nurse she is not under the influence. Jackson says the defense showed the jury none of that.
Direct Examination (Roger Rosen)
• Background: Los Angeles City firefighter paramedic. Paramedic since 1998. Thirteen months with LAFD at the December 24, 2001 call. Nearly seven years on the job by trial.
• The call: Hollywood Hills Christmas party with senior partner Bruce Liverpool (~17 years).
• Injuries: Obvious bilateral wrist fractures, only the second double-wrist break of his career.
• Treatment: Splints, distal pulse, motor, and sensation, IV, then a morphine order. She was crying in pain from visible bone deformity.
• Sobriety: Alcohol odor, slurred speech, and other impaired partygoers. He called her inebriated, or under the influence.
Cross-Examination (Alan Jackson)
• No notes: Stark wrote nothing about sobriety at the time. Liverpool filled out the forms.
• Defense contacts: Met Rosen and investigator Tawny Tindall. Shown one party photo, not a headshot (People's 14).
• Alertness: Alert and oriented times four. Glasgow Coma Scale. Answered allergies and medications through tears.
• No sobriety tests: No nystagmus or FSTs. Walked only four to five feet onto a gurney.
• People's 57: Base hospital form from Liverpool's radio call, ETOH, written by the MICN.
• Defense Quadruple E: EMS report alcohol box left blank by Liverpool.
• Other explanations: Sobbing, pain, and possible shock can slur speech. A recent drink can explain odor. Not staggering drunk.
Redirect (Rosen)
• Why he remembers: New at Station 27, famous people, unique double wrist fractures.
• Opinion stands: Odor, slurred speech, demeanor, and ongoing patient assessment.
Recalled Testimony
• Roles: Stark drove. Liverpool attended in the back. Destination Cedars-Sinai.
• Radio dispute: Stark said he was in the cab and did not hear a no-alcohol report.
• Form times: On scene 1112 PM. Base contact 1135 PM. Transport 1144 PM.
• Jackson: The call was nine minutes before transport, so Stark was still in the back.
• Stark: He sits in the cab until a destination is set, then they leave. He did not recall being next to the radio.
• 902M morphine: Titrated 4, 4, and 2 milligrams. First push1123PM, 12 minutes before the 1135PM base order. Later pushes 1139PM and 1155PM.
• Protocol: Alcohol is not a contraindication for morphine. He would have corrected Liverpool if he had heard a no-alcohol report because it affects ER toxicology and consciousness tracking.
• Times: Watch estimates versus computer logs. Denied lying. Same ongoing assessment standard applied to Liverpool during transport.
• Exhibit 195: Dispatch sheet for Rescue 27. Two transport times. Stark had never seen the document.
