Day 8 of the Faith Hedgepeth murder trial: the five moments that mattered, in court order. The defendant is presumed innocent. I am not the jury, and only the jurors decide.
0:00 What this video is, and a preview
0:18 Video starts: TOP MOMENT 1: Why only the cap and the bottom of the Bacardi bottle
On redirect, Erin Ermish says latent print chemicals can destroy DNA, and that analysts from other sections have turned up in DNA profiles at the lab. The cap: component one, attributed to Faith, about 95.49 percent; component two, about 4.51 percent, which the calculation "best fits" the defendant. On recross, defense attorney James Rainsford asks why she swabbed only the cap and the very bottom. Why it made the five: the State explains the split, and the defense presses on what was never swabbed.
8:34 TOP MOMENT 2: Never friends, and a call from the defendant's mother
Eldis Cordero Ordonez, related to the defendant by marriage: "I was never friends with him." The defendant's mother called before he testified and asked him to tell the truth, because they had never spent time together, "not even in a cookout." Why it made the five: the jury hears what the defendant's mother asked of a witness, and the cookout comes up before its host takes the stand.
23:16 TOP MOMENT 3: The cookout host cannot place the defendant
Luis Lopez: beer, brothers-in-law arriving one by one, Abel, then Abel's friend. "But I don't remember him." Does he know the defendant? "No, I don't know him." Could the defendant have been the friend Abel brought? "No, I don't remember." Why it made the five: the State's witness puts an unnamed man at the cookout and cannot put a face to him.
35:52 TOP MOMENT 4: The translations come in, argued with the jury out
The defense objects: no chance to cross-examine the translator, a confrontation and due process problem, and the "I shot the clerk" scene from My Cousin Vinny. The State answers with certificates of accuracy and State v. Felton, a 1992 North Carolina case. The judge: "I am going to allow for that," and, "This matter has been going on since 2012." Why it made the five: the day's process moment, the ruling that decided what the jury hears in Top Moment 5.
51:08 TOP MOMENT 5: The booking-room translation
The SBI agent reads the certified translation of the defendant talking with his mother in Spanish in the Chapel Hill police booking room on the date of his arrest: "But how am I going to explain something that I I didn't do?" "Mom, but I don't know the woman." "I have not seen her in my life." Why it made the five: the State offered it, and what the jury heard was the defendant, in translation, saying he never knew her. The agent is still on direct when court adjourns.
